This Privacy Policy describes how McGaw YMCA (“McGaw”, “us”, or “we”) collects, uses, shares, and protects your personal information when you interact with our websites, our mobile application, emails we send, and our social media accounts (collectively, the “Services”).

Please refer to this Privacy Policy regularly. McGaw may need to change this Privacy Policy from time to time. The “Effective Date” at the top of this page indicates when the Privacy Policy was last revised. We may also notify you in other ways from time to time about the collection, use, and disclosure of your personal information described in this Privacy Policy.

Scope

This Privacy Policy does not apply to your use of unaffiliated websites or services to which our websites link or that state that they are offered under a different privacy policy. Please review the privacy policies on those websites and services directly to understand their privacy practices.  This Privacy Policy does not apply to Personal Health Information (“PHI”) collected through the McGaw Diabetes Prevention Program or any other program offered by McGaw that requires the collection of PHI or other HIPPA protected information.

Collection of Personal Information

Depending on the nature of your interaction with us, we may collect personal information as follows:

  • Directly from you, when you provide information to us or interact with our Services:
    • Contact information and any other information you choose to include when you communicate with us via email, mail, phone, or other channels.
    • Account and membership information, such as an email and password, your name, mailing address, phone number, date of birth, emergency contact information, photo identification card, and usage and subscription preferences, which may include signing up to some communications from us.
    • Transactional information including name, email address, physical address, telephone number, and payment card information if you engage in a transaction or make a donation through the Services.
    • Health information in connection with various fitness programs, health screenings, or other health services that we may provide from time to time.
    • Job applicant information, such as your name, employment history, and educational history if you apply for employment with us.
    • Housing applicant information, such as your name, date of birth, demographic information, employment and criminal history, government identification (e.g. Social Security number), and income verification documentation.
    • Volunteer applicant information, such as your name, date of birth, contact information, and criminal history.
    • Survey information in response to questions we may send you through the Services, including for feedback and research purposes.

Some of this information may be collected by external parties on our behalf. For example, we use a payment processor when you engage in a transaction on our services; McGaw does not itself collect or store payment card information.

If you provide us with personal information regarding another individual, you represent that you have that person’s consent to give us his or her information and to permit us to use the information in accordance with this Privacy Policy.

  • Automatically from you, when you utilize or interact with our Services. This includes:
    • Usage details about your interaction with our Services (such as the date, time, and length of visits, and specific pages or content accessed during the visits, search terms, frequency of the visits, referring website addresses).
    • Device information including the IP address and other details of a device that you use to connect with our Services (such as device type and unique device identifier, operating system, browser type, mobile network information, and the device’s telephone number).
    • Location information where you choose to provide us with access to information about your device’s location.

Much of this information is collected through cookies operated by our partners who assist us in serving ads or other services. For example, we use Google Analytics to conduct analytics and to collect information about usage details. You may prevent your data from being collected and used by Google Analytics by opting out through the use of the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout. We also use Google Ads to customize our advertising and to serve you ads based on your browsing behavior. Google uses cookies to serve you ads based on your prior visits to our Services and other websites on the internet. These cookies allow your behavior to be tracked after you have been redirected to our Services by clicking on an ad. Use of Your Personal Information

We may use your information for any of the following purposes:

  • Provide our Services to you, including to maintain your account, enroll you in requested programs, manage your transactions and donations, and provide information or other important notices.
  • Respond to your inquiries, questions, and other requests, and provide support.
  • Improve our Services and grow McGaw, enhance our product offerings, understand our consumer base and effectiveness of our marketing.
  • Send you marketing materials we feel may be of interest to you and tailor the content we display to you on the Services and communications, including advertising.
  • Offer and maintain the Services, monitor performance of the Services, ensure the security of the Services, diagnose and fix technology problems, and conduct analytics on your use of the Services.
  • Comply with legal and regulatory obligations, establish, protect, or exercise our legal rights, defend against legal claims or demands, and detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.
  • Recruit and evaluate job candidates, housing applicants, and volunteers.

We may also use and share in an aggregate or de-identified manner information at our discretion, including for research, analysis, marketing, and improvement of the Services.

Sharing of Your Personal Information

We may share your information as follows:

  • With service providers that we believe need the information to perform a technology, business, or other professional function for us such as payment processors, technology partners, IT services, and other professional services.
  • With advertising and measurement partners who assist us in serving advertisements regarding the Services to others who may be interested in the Services, or who use cookies to display interest-based advertising to you on the Services. These third parties use tracking technologies on the Services to collect or receive information from the Services and elsewhere on the internet and use that information to provide measurement services and target ads. Third parties may allow other companies to access information about you so that they may market other products you may be interested in.

  • To prevent harm or if we believe it is necessary in order to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.
  • As part of a business transaction with another entity or its affiliates or service providers in connection with a contemplated or actual merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets, or if we undergo bankruptcy or liquidation. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Privacy Policy.

Please note that we do not rent or sell your personal information.

Information Protection

We take appropriate administrative, technical, and physical measures to safeguard against unauthorized processing of personal information, and against the accidental loss of, or damage to, personal information.  However, we cannot provide an absolute guarantee of the security of any website, network, or device we operate or that are operated on our behalf. If you are located outside of the United States, you understand that we may collect, process, and store your personal information in the United States and other countries.

Privacy of Children

We recognize the importance of protecting the privacy and safety of children. We do not knowingly or intentionally gather information from children. However, to provide some of our Services, we may need to collect personal information about children from their parent or legal guardian, such as when the child is registered for an event or activity. If we have inadvertently collected personal information from a child directly, a parent or guardian of that child may contact us at [email protected] to request that we delete the information from our records or otherwise cease the use of that information in accordance with applicable law.

Please do not send Social Security numbers or other sensitive information to us via unencrypted email.
  • Unsubscribe from marketing communications: If you no longer wish to receive marketing communications from us, you can click the unsubscribe link at the bottom of any email from us or contact us at (847) 475-7400.
  • Change or view your cookie preferences: You have several options to either prevent our collection of information regarding your online activity, or prevent third parties from using such information for interest-based advertisements:
    • You can modify your browser setting to disable or reject cookies across the internet; but if you do so, some features of our Services may not function properly or be available. If you are visiting the Services from a mobile device, the operating system of the device may offer you options regarding how the device collects and uses your information for interest-based advertising.
